TRIBUNAL CASE LAW HANDBOOK 2021

The Competition Tribunal is pleased to announce the publication of its updated handbook on case law, now available in electronic format on the Tribunal’s website.


The Tribunal Case Law Handbook 2021 is an update of the first edition, published in July 2020, as a guide to selected cases spanning two decades. 

 

The updated handbook is authored by Tribunal member, Yasmin Carrim, assisted by: Tribunal case manager, Camilla Mathonsi; former senior economist at the Tribunal, Karissa Moothoo Padayachie; and Rendani Neswiswi who has provided IT and layout support.

 

Covering various topics ranging from substantive merger control issues and procedural matters to cases dealing with prohibited conduct and remedies, the handbook captures the Tribunal’s unique institutional approach to cases and serves as a guide for competition law practitioners.  

 

Among others, the new topics include: cases dealing with Covid-19 related complaints decided by the Tribunal; the question of the Tribunal’s jurisdiction over foreign entities; the powers of the Tribunal to vary consent orders; the exercise of the Tribunal’s inquisitorial powers; access to confidential information; the approach of the Tribunal to the question of indivisible transactions; and expanded public interest grounds in mergers introduced by the 2019 amendments to the Competition Act.
